Drug crime charges dismissed for man due to inaccurate field test

On Behalf of | Feb 18, 2015 | Drug Charges

When a resident of Minnesota is facing drug charges, it may feel as if all hope is lost and that there is nothing he or she can do to get out of such a mess. However, this is not necessarily true. There are many drug crime cases that result in charges being dismissed, which allows the accused individual to avoid time in prison and a life-altering criminal record. With appropriate representation and understanding of the law, accused individuals may be able to avoid the harsh consequences that are associated with a drug conviction.

For one man here in Minnesota, this has happened to him. He spent several months in jail after being charged with drug possession. He was facing two felony charges, and the court set his bond at half a million dollars. However, he didn’t have drugs on him when he was arrested.

Supposedly, authorities suspected that the man had illegal drugs on him. A field test determined that a powdery substance that the 31-year-old man had was indeed amphetamine. However, after the arrest, another test was done on the powder that determined that it was actually vitamins. His felony drug possession charges were dismissed just before he was scheduled to go to trial.

Criminal drug charges will not always result in a drug crime conviction. Tests that are conducted by authorities out in the field are not always 100 percent accurate, as witnessed with this particular case. This case also goes to show those who have been accused of similar crimes here in Minnesota that they should never lose hope of obtaining a dismissal.
