Minnesota man sentenced in alleged rape of 2 teenage girls

On Behalf of | Aug 22, 2014 | Sex Crimes

Last year, a Minnesota man was accused of forcibly having sex with two teenage girls on two separate occasions. Recently, prosecutors admitted that further investigation might not support rape charges. Therefore, the 19-year-old recently pleaded guilty and was sentenced for two counts of criminal sexual conduct in the third degree.

One count pertains to a girl who was 13 at the time of the alleged rape. After a visit to Minnesota’s Mall of America, she and her friend went to the home of another boy who was with them and the accused man. She claims that he forced her to have sexual intercourse with him. She claims that he assaulted her even though she told him she did not want to have sex, but she became scared of him when his tone of voice changed.

The other count is for the alleged rape of a 15-year-old girl that occurred approximately five months after the incident with the other girl. The two chatted on Facebook. On Aug. 6 at around 4 a.m., he went to her home. He admits to having sex with the girl, but says it was consensual. She claims that she attempted to stop him more than once and became scared when he supposedly became aggressive.

No one can deny that rape is a serious crime, and the penalties for a conviction can be serious. In this young man’s case, rape could not be proved beyond a reasonable doubt, but he and his criminal defense team still believed it was better to plead guilty to reduced charges than to risk going to trial. He will not have to spend any additional time in jail since he received credit for time served, but he will be on probation for 15 years and is branded a predatory sex offender. In some cases, even though the evidence of a crime is shaky, the emotional impact of the crime on the jury must be taken into consideration — such as the rape of two seemingly helpless young teenage girls.
